Resignation during probation period

Resignation during probation period
Hi All,
need abit of help.
I've started in a new role, been here about 6-7 weeks now. But its not turned out the way i expected.
So i want to resign but i don't know how much notice i need to give? ive read my contract and it does not mention any notice period for termination/resignation during my probation , nor does it have a mention of a probtion period.
But while i've been having talks with my Boss he says my probation period finishes on the 16/10/10 and he is to decide whether i will stay on.
The notice period in my contract states 1 month but what if i want to leave during my probation period? I have no idea how much notice to give so i can start looking elsewhere.
Any input would be a massive help.

If you aren't happy there, say so to your boss. They might be interested in changing the conditions of your employment to help suit want you want. If not possible, then it's up to the employer. If you don't want to stay, they might prefer to let you go straight away. But if they need you to fill in until they can arrange a replacement, then they'll probably want to hold on to you. Just think about it from your employers perspective to see what's in their best interests... and talk to them.

as a rule its 4 weeks notice

If u are working full time it's legally 2 weeks notice but during the 3 month prob. Period anything can happen.

i kind of thought it would be 4 weeks aswell.

Sorry to hear it hasn't worked out mate,

Provided your not employeed casually and you have worked there less than one year then you would normally need to give one weeks notice, however if you are still within your probationary period you may have a clause in your contract that allows you to walk or for your employer to dismiss you witout notice. I thought the whole idea of a probation period was so either party (employer/employee) can cease at any time (no notice).

maybe talk to the government body in your state.

Go to your employer and talk to them. Dont burn any bridges as your next employer might contact your current one!

If you don't have a probationary period specified in your contract, then you're not subject to a probationary period. Your boss can't just unofficially claim that you're in a probationary period.
